We’ll try to keep this as short and sweet as possible.

At COVE 27, we value both our customers and our producers very highly. To ensure everyone is happy, it’s important to have a few rules and regs. 

So, we need a moment of your time as, by law, we have to explain the conditions that apply if you want to use our service.

As a condition of using the COVE 27 website, the app and other services as they come along (our “Service”), you agree to comply with and be subject to the following terms and conditions of use.

You may not agree with these terms and conditions, and if that’s the case, please do not use our service, thanks for visiting and enjoy the rest of your day.

A FEW EXPLANATIONS

  • Electronic Messages – these includes communications such as emails, text messages, push notifications, phone calls and any similar kinds of messaging that tech buffs invent from time to time.
  • User/You/Customer/Member – refers to any person accessing our service.
  • We/Us/Our – that’s us, COVE 27, which is a trading name of Nineyards Digital Limited.

 

 

RESPONSIBLE SERVICE

As it’s illegal in New Zealand to sell or supply alcoholic beverages to anyone under eighteen (18) years of age, only persons over that age may use this service. By registering and using this service, you are confirming that you are over the age of eighteen (18) years of age and legally allowed to buy alcohol in New Zealand. 

If you are fortunate enough to look under 25 years of age, the courier delivering your order may ask for valid ID to prove you are over eighteen (18) years of age.

COVE 27 encourages the legal and responsible consumption of alcoholic beverages.

PERSONAL USE

You agree that you will only register one (1) account as a user. In the instance where we discover multiple accounts (registrations) per user we may close some or all of the accounts at our discretion.

In the event we offer special deals, you agree not to post these deals in any public forum. If you do we may, at our discretion, close your account.

We reserve the right to refuse the registration of any potential customer at our sole discretion.

You agree that products purchased from us are for personal use only, and not to be on-sold.

The service shall be used for lawful purposes only – which means you agree that you will not: use, share, upload, post or create any obscene, offensive, indecent, defamatory, abusive, harassing, hateful, threatening, pornographic, false, inaccurate or other inappropriate material or content including text, images or illustrations.

In addition, you may not use, upload, submit, post or share any material or content that is encrypted, may be considered as unauthorised advertising, contains software viruses or malware, invades anyone’s privacy, encourages conduct that may constitute a criminal offensive or give rise to civil liability, that may violate and local or international laws or regulations, or that is offensive or may cause offense. We reserve the right, at our sole discretion, to edit or delete any content or material that we feel breaches these Terms of service.

You agree and acknowledge that your failure to follow the rules outlined in these Terms of Use may subject you to civil and/or criminal liability and at Cove 27’s sole discretion, termination of your account.

PRICES & TAXES

All the prices shown in our services are inclusive of GST, unless expressly stated, and are in New Zealand dollars.

DELIVERY

Please refer to our Shipping and Handling page for details regarding the terms of delivery and product returns.

PRODUCT RANGE AND AVAILABILITY

We will do our best to complete orders as requested by customers; however, we cannot guarantee that every order will be fulfilled as ordered - if there’s an unexpectedly high demand for a particular product, this may lead us to run out of stock. In this unlikely event, we will contact you with your options. These can include sending you something else we have in stock, and the out of stock item later; replacing the out of stock product with a similar one, or simply refunding your money for that product. 

On occasion, we may limit quantities or ranges of products per customer. We may do this with small batch or exclusive products, so we can offer them to more customers.

PAYMENT

We accept Visa and Mastercard in our secure online checkout. We will also introduce other credit cards and payment methods and these will be explicitly stated at the time of checkout. All charges will be in New Zealand dollars (NZD).

RETURNS & CANCELLATIONs

INSURANCE AND RISKS

We insure our products right up until the point of delivery, which means they aren’t covered for any damage or theft after that point.

Please keep your login details safe and confidential at all times. We don’t want anyone’s account being accessed without you knowing.

LIMITATION OF LIABILITY

We will honour all our obligations under the Consumer Guarantees Act 1993 (CGA).

We provide our services in good faith, but we don’t make any representations or warranties of any kind, express or implied, in relation to all or any part of the service; all warranties and representations are hereby excluded to the extent of the permitted law.

The contents of the service do not constitute advice and should not be relied upon in making, or refraining from making, any decision.

To the extent permitted by law, we hereby disclaim all liability (however it arises) in connection with any loss and/or damage, arising out of or in connection with any use of, or inability to use, all or any part of the service.

In order for us to offer our services we need to collect, store and use personal information, for example, your name, address, email address and contact number.

We will store this information securely, will never sell your data and comply with relevant privacy laws.

Our online store is hosted on Shopify Inc. Shopify Inc. is a Canadian multinational e-commerce company headquartered in Ottawa, Ontario, Canada. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify’s data storage, databases and the general Shopify application.

We also use Shopify's Shop Pay as a safe and convenient method of checking out (including paying), it remembers your important details, so you can fill carts, not forms on COVE 27 and other Shopify hosted stores. We use trusted third parties for our deliveries and email and sms marketing and we share with them necessary information about you and your order to the extent necessary to allow them to perform the services they provide to us. Please refer to our Privacy Policy for more details.

CONTENT AND LINKS

While we try make every effort to keep the content and material in our website and app as current and accurate as possible, we can’t guarantee or warrant its accuracy, completeness or quality and it is provided as general information only.

Your use of any information or materials on the service is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, information or other parts of the service meet your specific requirements.

Any information placed on the service by users – including, but not limited to, ratings, images, icons, emojis, hashtags, comments, notes and other drink information, advice and opinions - is the view and responsibility of those users and does not necessarily represent the view of Cove 27.

You agree and acknowledge that, by using the service, you grant to us an irrevocable, perpetual, indefinite, non-exclusive, royalty-free, sub-licensable, transferable worldwide license, and all the necessary consents, to use, download, make copies of, store, edit and display any content or material that you upload, post or otherwise display or share via the service, for the purpose of providing the service. We reserve the right to edit or delete all or part of the content or material at any time at our sole discretion.

The service may include references and links to other websites and apps, producers, suppliers, people and other third parties and are provided solely for convenience. Such references and links do not indicate any endorsement by us. Linking to any other site, app or service from this service is at your own risk and understanding that those sites, apps or services may have their own terms and conditions.

INTELLECTUAL PROPERTY AND COPYRIGHT

The service contains material that is owned by or licensed by Nineyards Digital Limited. This material includes, but is not limited to, the design, layout, graphics and appearance. 

No part of COVE 27 may be copied or distributed for any purpose, and you are not permitted to incorporate the contents or materials of COVE 27, or any part of it, in any other work or publication (in any form). In addition, you may not copy, remove or alter any content or material that appears on COVE 27.

You agree and acknowledge that you shall be solely liable for any costs, loss and damages caused (directly or indirectly) by anything you do that results in a claim that any copyright, trademarks, or any property rights have been infringed. This includes paying for any related legal fees such as lawyers and court fees.

FORCE MAJEURE

In the unlikely event that the performance by COVE 27 of its obligations is prevented by reason of “force majeure” such as, but not limited to, fire, act of God, natural disaster, regulation, labour disputes, labour shortage, shortage of product availability, electricity or communications failures or any other causes beyond Cove 27’s reasonable control, COVE 27 shall be excused from the performance of its obligations under these Terms and Conditions.

OFFERS, PROMOTIONS AND REFERRAL CREDITS

COVE 27 reserves the right to change the terms and conditions of, or otherwise modify, suspend or cancel any promotional code, other promotional methods or related offer at any time, at its sole discretion. Only one promotional code can be applied to an order. 

If COVE 27 suspects any fraudulent activity is associated to any promotion, competition or offer, COVE 27 reserves the right to withdraw or revoke any credits or discounts at its sole discretion.

In the event COVE 27 offers referral or welcome credits, such credits shall expire within three (3) months from the date of issue. COVE 27 reserves the right to modify, suspend or cancel unused referral or welcome credits at any time. Available credits will be automatically applied to orders.

OVERSEAS SHIPMENT

In the event that COVE 27 agrees to ship products from New Zealand, we do not refund any applicable taxes such as GST or duties. You acknowledge and agree that shipments may be subject to local laws, taxes or duties of the receiving country, and complying with such laws, taxes and duties is the sole responsibility of the purchaser. In addition, overseas shipments may be subject to inspection and ID being provided to customs or law enforcement; this is the sole responsibility of the purchaser.

The purchaser shall be advised of international postage fees and these must be paid prior to any order being shipped.

GOVERNING LAW

The terms and conditions and any dispute arising from the use of our service shall be governed by the laws of New Zealand. The parties submit to the exclusive jurisdiction of the courts of New Zealand.

NOTIFICATIONS

You may from time to time receive push notification messages to the app or website, text (sms) messages and emails. These messages are triggered by different events, including but not limited to, registration confirmation, change in password confirmation, a new recommended drink alert, new user follower notification, order and dispatch confirmations.

CHANGES TO TERMS OF USE

We reserve the right to modify or replace these terms and conditions, or change, suspend, or discontinue the service (including, without limitation, the availability of any product, feature, function, material or content) at any time. Your continued use of the service following the posting of any changes to these terms and conditions constitutes acceptance of those changes.

SUBSCRIPTIONS

We may offer various subscriptions within the service for your convenience. You can cancel at any time by accessing your account. Please note the subscription renewal dates when unsubscribing. Your subscription will continue until cancelled.
